Contemptuous Capture

A Massachusetts judge, Shelley Joseph, and a court officer, Wesley MacGregor, are facing federal charges for allegedly helping a defendant, a twice-deported Dominican national facing drug charges, evade ICE custody in 2018. The Justice Department alleges that Joseph and MacGregor conspired to obstruct immigration enforcement by allowing Jose Medina-Perez, to leave the courthouse through a back door, effectively preventing ICE agents from arresting him.

The government contends that Joseph’s actions were motivated by a desire to protect Medina-Perez from deportation. Evidence presented includes video surveillance footage allegedly showing Medina-Perez being escorted out of the courtroom and interviews with court personnel.

Joseph maintains her innocence, arguing that she was prioritizing safety and upholding the rights of the defendant. Her defense team argues she was concerned Medina-Perez might be targeted by ICE within the courthouse. They also point to ambiguities in the law regarding the power of immigration officials to make arrests within courthouses.

The case has ignited a debate about the role of judges in immigration enforcement and the extent to which courthouses should be considered safe havens from federal law enforcement. The trial continues to unfold, with both sides presenting evidence and arguments regarding Joseph and MacGregor’s intent and actions on that day in 2018. The outcome will have significant implications for the relationship between state courts and federal immigration authorities.
