Donald Trump’s legal team is pushing for a mistrial in the E. Jean Carroll defamation case, citing potential jury misconduct. They allege that Carroll’s lawyer shook hands with a juror after closing arguments and that Carroll herself mouthed “Thank you” to the jury. Trump’s lawyers argue that these interactions could have influenced the jury’s decision.

Judge Lewis Kaplan, however, expressed skepticism about the motion, noting he had not seen the alleged handshake and found Carroll’s supposed “Thank you” unremarkable, stating that it was a common expression of gratitude. He denied Trump’s immediate request for a mistrial during the proceedings.

The motion is based on observations made by Trump lawyer Alina Habba. The defense argues that the interactions created the appearance of impropriety, potentially swaying the jury in Carroll’s favor. They believe the jury’s impartiality was compromised.

The case involves Carroll’s claim that Trump defamed her while denying her allegation of sexual assault. Trump’s defense contends that his statements were protected speech and did not constitute defamation. The jury ultimately found Trump liable for defamation and awarded Carroll $83.3 million in damages. The motion for a mistrial is the latest development in the ongoing legal battle.
