Donald Trump has asked the Supreme Court to intervene in the dispute over classified documents seized from his Mar-a-Lago estate, specifically requesting that the court reinstate a special master’s review of approximately 100 documents marked as classified. This appeal follows a decision by the 11th Circuit Court of Appeals that sided with the Justice Department, halting the special master’s examination of these classified documents.

Trump’s legal team argues that the appeals court overstepped its authority by preventing the special master, Judge Raymond Dearie, from reviewing the documents. They contend that the government has not sufficiently proven the classified documents are indeed classified and that the special master is crucial for ensuring fairness and protecting Trump’s rights, especially concerning potential attorney-client and executive privilege issues.

The Justice Department has argued that the documents pose a national security risk if improperly disclosed and that the special master review is unnecessary and would impede their investigation into Trump’s handling of classified materials after leaving office. They maintain that the classified documents are clearly marked and their classified status is beyond dispute.

The Supreme Court’s decision on whether to hear the case could have significant implications for the ongoing investigation and the scope of the special master’s review. If the court agrees to hear the case, it could potentially delay the Justice Department’s investigation and lead to a more extensive review of the documents. If they decline, the appeals court ruling stands, and the Justice Department’s investigation can proceed without the special master’s involvement in the classified documents.
