The ruling stems from a lawsuit filed by Missouri Attorney General Andrew Bailey, who argued that the board violated the First Amendment by potentially censoring or chilling free speech.
The judge found that the government exceeded its authority in creating the board, stating that Congress had not explicitly authorized DHS to regulate speech. The ruling criticized the administration for its lack of transparency and clarity regarding the board’s scope and powers, contributing to concerns about potential government overreach.
The Disinformation Governance Board, intended to combat the spread of misinformation online, particularly related to national security, immediately faced strong criticism from Republicans and some civil liberties groups. Opponents argued that the board could be weaponized to suppress dissenting opinions and silence viewpoints the government deemed unfavorable.
The board’s initial executive director, Nina Jankowicz, also became a target of intense online harassment, further fueling the controversy. Following the public backlash and legal challenge, the DHS paused the board’s activities in May. The recent court order effectively mandates the permanent termination of the board and prohibits the government from reinstating it without explicit Congressional approval.
