Nauru Deportation Rights Axed

The Albanese Labor government in Australia is enacting measures that could lead to the re-detention of approximately 350 former immigration detainees. This follows a High Court ruling that deemed indefinite detention unlawful for individuals who cannot be deported.

The proposed legislation allows the government to apply for preventative detention orders (PDOs) for individuals considered a risk to the community. These PDOs, which are expected to be granted easily, would allow for the immediate re-arrest and detention of these individuals, effectively circumventing the High Court decision.

The government also seeks to create a new visa category that would limit the rights of these former detainees, placing further restrictions on their freedom and ability to work or integrate into society.

Ultimately, the plan is to transfer these re-detained individuals to Nauru, an island nation already known for its controversial offshore processing of asylum seekers. This move would re-establish a form of indefinite detention, shifting it from mainland Australia to a remote location.
