After consulting with lawyers, Colbert realized he couldn’t legally use the old clips. Instead of giving up, he introduced a new, legally distinct character named “Stephen Fölbert,” complete with slight costume and makeup changes.
“Stephen Fölbert” essentially satirizes the same topics and utilizes a similar comedic style as the original “Colbert Report” persona, allowing Colbert to continue offering political commentary with a familiar feel while circumventing the legal restrictions imposed by CBS. He joked about the absurdity of the situation and the lengths he had to go to in order to continue a comedic bit. The new character allows Colbert to satirize the legal battle itself and highlight the somewhat ridiculous nature of copyright restrictions.
