Robert F. Kennedy Jr. lost a libel lawsuit against CNN over its coverage of his views on COVID-19 vaccines. The suit stemmed from a CNN segment in 2021 in which commentator Ana Navarro described Kennedy as having made “factually incorrect” and “crazy” anti-vaccine claims. Kennedy argued that CNN deliberately misrepresented his views and defamed him by associating him with dangerous conspiracy theories.
U.S. District Judge for the Central District of California, Dale Fischer, dismissed the lawsuit, ruling that Kennedy failed to demonstrate that CNN acted with actual malice, a requirement for libel claims against public figures. The judge stated that Kennedy did not provide sufficient evidence to prove that CNN knew its statements were false or acted with reckless disregard for the truth.
The judge found that Navarro’s characterization of Kennedy’s views, even if critical, was based on her interpretation of his publicly stated positions on vaccines and the COVID-19 pandemic. The ruling emphasized the importance of protecting freedom of speech and allowing journalists to report on and criticize public figures, even when the criticism is harsh. The judge further stated that the commentary fell within the realm of protected opinion and fair reporting on matters of public concern. Kennedy’s legal team has not yet indicated whether they will appeal the decision.
